This area of practice relates to matters arising under the ACTPS employment framework comprising enterprise agreements, the Public Sector Management Act 1994, and the Public Sector Management Standards 2016. Type of matters include industrial disputes on the interpretation of enterprise agreement provisions and response to proposed industrial action, employment claims included unfair dismissal, general protection, and discrimination matters. Activity during the period involved:

  • responding to industrial disputes raised under ACT Public Service enterprise agreements; disputes and claims brought before the Fair Work Commission, the Federal Circuit Court and the Federal Court, as well as before the ACT Human Rights Commission (ACT HRC)
  • providing advice regarding ACT Public Sector enterprise bargaining, including revisions to ACT public service enterprise agreement and industrial action commenced with respect to such enterprise bargaining, employee matters at executive, officer and employee levels
  • preparing appointments and delegations under the Public Sector Management Act 1994, Public Sector Management Standards 2016, other Territory laws and ACT public service enterprise agreements
  • advising industrial and employment obligations of service providers contracted to the ACT public sector, including service contracts for the cleaning of ACT Government public schools
  • managing obligations under the Fair Work Act 2009 (Cth) and the Work Health and Safety Act 2011, including with respect to rights of entry and enforceable undertakings
  • handling employee claims made as disclosures under the Public Interest Disclosure Act 2012, and
  • managing claims under section 550 of the Fair Work Act 2009 (Cth) against the Territory.
