The ACTGS provides advice and representation to directorates and statutory office holders in relation to the exercise of regulatory, statutory, and other functions.  Activities over the reporting period included:

  • providing advice to the Commissioner for Fair Trading in relation to alleged breaches of the Australian Consumer Law across a variety of industries and appearances in occupational discipline proceedings in the ACT Civil and Administrative Tribunal
  • appearing on behalf of the Construction Occupations Registrar in relation to rectification orders issued to licensees to remedy defective building work
  • providing advice to the Road Transport Authority on operational matters and appearing on its behalf in contested applications for a restricted driver license
  • providing advice and representation to the Commissioner for ACT Revenue for various administrative review proceedings relating to the imposition of payroll tax, land tax stamp duty, lease variation charges, rates, and other matters under various tax laws,
  • representing the Commissioner for ACT Revenue in judgement debt applications, winding-up and insolvency proceedings in relation to defaulting corporate taxpayers, and bankruptcy proceedings in relation to defaulting individual taxpayers
  • providing advice and representation to the Registrar of Domestic Animal Services in proceedings before the ACAT concerning attacking, harassing, and menacing dogs
  • providing advice in relation to the application of the Territory Records Act 2002 and the Information Privacy Act 2014, compliance with subpoenas, and requests for information under the Freedom of Information Act 2016 and the Health Records (Privacy and Access) Act 1997
  • representing Environment, Planning and Sustainable Development Directorate in relation to
  • several development applications, including administrative review proceedings in the ACAT, and

filing and responding to applications for workplace protection orders and appeared in contested applications on behalf of directorates and Territory agencies.
