The Justice and Community Safety Directorate is consulting on the recommendations of the ‘Review of ACT Civil Surveillance Regulation Report’ - an independent review report into the regulatory framework for non-government surveillance in the ACT. The Minister for Justice and Consumer Affairs announced the independent review on 5 May 2016.
The review report makes ten recommendations for improving the regulation of surveillance in the ACT including generally prohibiting surveillance by any device unless for the purpose of protecting an individual’s lawful interests or for a purpose in the public interest.

The Government is calling for submissions on the recommendations in the review report to inform a response to the recommendations, and consideration of reforms to surveillance legislation to encourage the responsible use of new and emerging technologies that support our digital city while appropriately protecting personal privacy.

All submissions that are not clearly marked ‘Confidential’ may be made public or quoted in the Government response. You can also provide submissions anonymously. In the absence of a clear indication that a submission is intended to be confidential, submissions will be considered as non-confidential and will be published on the Justice and Community Safety Directorate website. Any request for access to a confidential submission is determined in accordance with the Freedom of Information Act 1989, which has provisions designed to protect sensitive information given in confidence.
